These terms govern your use of Audial's website, API, Python SDK, MCP server and plugins (together, the "Service"). By creating an account or using the Service you agree to them.
The Service
Audial provides hosted AI audio tools: stem separation, mastering, audio to MIDI, sample packs, song segmentation, music generation, resynthesis into synth presets, and vocal synthesis from lyrics. Processing runs on our servers; the plugins, SDK and MCP server are clients for it.
Your account
You need an account to use the API and the generation features. Keep your credentials and API keys private; you are responsible for what is done with them. Tell us at contact@audialmusic.ai if you think a key has been exposed and we will revoke it.
Subscriptions and billing
The generation features require a paid subscription. Plans and prices are listed on the pricing page. Subscriptions renew automatically until cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period and you keep access until then. Payments are processed by Stripe under Stripe's terms. If a job fails because of a fault on our side, contact us and we will put it right.
Your content
You keep all rights to the audio, MIDI, text and other material you send us ("Input"). You give us permission to store and process it only as needed to provide the Service to you. You must have the rights you need for everything you send, including:
- the rights to any recordings and compositions you upload;
- for text2vox and any feature that imitates a voice, the consent of the person whose voice is used, or the voice must be your own.
Outputs
You own the stems, masters, MIDI, presets, songs, vocals and other results the Service produces for you ("Output"), and you may use them commercially, subject to the rights of any third parties in your Input. Because similar Input can produce similar Output for other users, Output may not be unique and we do not guarantee that it is. You are responsible for checking that your use of Output does not infringe anyone else's rights.
Acceptable use
Do not use the Service to:
- process material you do not have the rights to;
- clone a real person's voice without their consent, or produce content that impersonates a person;
- generate content that is unlawful, defamatory, harassing, or sexually exploitative of minors;
- probe, overload, scrape or disrupt the Service, or circumvent rate limits or subscription checks;
- resell access to the API without our written agreement.
We may suspend or close accounts that break these rules.
Plugins and open source
Audial Synth is free software licensed under the GNU General Public License v3; its source is published on GitHub and the GPL governs your use of that software. text2vox is provided free of charge for use with the Service. Both plugins require a subscription for the features that call our API. We may stop distributing or updating a plugin at any time.
API and MCP server
Use of the API, SDK and MCP server is subject to rate limits and fair use. We may change endpoints with notice in the changelog and the API reference; we try not to break existing integrations without warning.
Availability and warranties
The Service is provided "as is". We work to keep it available and accurate but do not promise uninterrupted operation or any particular quality of Output. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Audial is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Termination
You can close your account at any time by emailing contact@audialmusic.ai. We can suspend or terminate accounts that breach these terms. Sections about content ownership, warranties and liability survive termination.
Changes
We may update these terms. We will change the date above and, for material changes, email account holders before they take effect. Continued use after the change means you accept the new terms.
Governing law
These terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law rules, and any dispute will be heard in the state or federal courts located there.
